Terms and Conditions for GZ Landscaping

Please read these Terms and Conditions (“Terms”) carefully before using the gzlandscaping.ca website (the “Site”) and the landscaping services (the “Services”) offered by GZ Landscaping (“us,” “we,” or “our”).

Your access to and use of the Site and Services is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Site or Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Site or use the Services.

1. Services GZ Landscaping offers landscaping services including, but not limited to, lawn care, interlocking, property maintenance, and gardening. The specific scope of services will be outlined in a written quote or service agreement provided to you (“Agreement”).

2. Quotes and Estimates Quotes are valid for 30 days from the date of issue unless otherwise stated. Acceptance of a quote or Agreement constitutes acceptance of these Terms. We reserve the right to adjust a quote if the scope of work changes or if unforeseen conditions arise that were not apparent during the initial assessment.

3. Communications By providing your contact information, you consent to receive communications from us, which may include emails, phone calls, and SMS text messages regarding your service, quotes, and occasional promotions. For SMS messages, message and data rates may apply. You can opt-out at any time as described in our Privacy Policy.

4. Client Responsibilities

  • You agree to provide accurate and complete information.

  • You agree to provide safe and unobstructed access to the work area.

  • You are responsible for securing pets before and during our service visit.

  • You are responsible for identifying and clearly marking all private underground utilities, sprinkler lines, irrigation systems, or other hidden obstructions. GZ Landscaping is not liable for damage to unmarked private lines or systems.

5. Payment Terms Payment terms are specified in your Agreement. Unless otherwise stated, a deposit may be required before work begins. Full payment is due upon receipt of the final invoice. Accepted payment methods include e-transfer, cash, and credit card (via Stripe). All prices are subject to HST.

6. Cancellations and Rescheduling

  • By Client: We require at least 48 hours’ notice for cancellation or rescheduling. Cancellations with less notice are subject to a fixed cancellation fee of $75.

  • By GZ Landscaping: We reserve the right to reschedule services due to inclement weather or other unforeseen circumstances. We will notify you as soon as possible to arrange a new date.

7. Our Guarantee & One-Year Interlocking Workmanship Warranty We strive for your complete satisfaction. If you are not satisfied with our work, please contact us within 48 hours of service completion to discuss a resolution. This does not cover issues from extreme weather, neglect, or pre-existing conditions.

GZ Landscaping provides a One (1) Year Limited Workmanship Warranty on interlocking stone installations, effective from the project completion date on your invoice. This warranty is for the original client and is non-transferable.

  • a. What This Warranty Covers: Defects in our installation workmanship, defined as:

    • i. Significant sinking, heaving, or shifting of pavers (more than 1 cm of displacement) resulting directly from improper base preparation by GZ Landscaping.

    • ii. Failure of edge restraints installed by us due to improper installation.

  • b. What This Warranty Does NOT Cover:

    • i. Defects in the paver materials themselves (e.g., cracking, fading). This may be covered by a separate manufacturer’s warranty.

    • ii. Normal wear and tear, scuffing, or scratches.

    • iii. Efflorescence (a natural, whitish deposit on concrete).

    • iv. Damage from misuse, abuse, neglect, impact, improper cleaning agents, or de-icing salts.

    • v. Damage caused by Acts of God (e.g., floods, earthquakes, extreme freeze-thaw cycles).

    • vi. Shifting caused by tree roots, soil conditions, or changes to property drainage not part of our contracted work.

    • vii. Damage from alterations or repairs performed by anyone other than GZ Landscaping.

    • viii. Growth of weeds or moss in paver joints. This is a homeowner maintenance responsibility.

    • ix. Staining from any substance.

  • c. Making a Claim: The original client must notify GZ Landscaping in writing at contact@gzlandscaping.ca within the one (1) year warranty period and within 14 days of discovering the defect. The notice must describe the issue and include photos. We reserve the right to inspect the installation.

  • d. Our Obligation: If a defect covered by this warranty is confirmed, our sole obligation is to repair or replace, at our discretion, the specific area deemed defective. We will use materials that match the original as closely as possible, subject to availability. Color/texture variations may occur and are not considered a defect.

8. Limitation of Liability To the fullest extent permitted by law, GZ Landscaping shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim relating to the services provided shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Intellectual Property The Site and its original content (text, graphics, logos) are the exclusive property of GZ Landscaping and are protected by copyright.

10. Governing Law These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

11. Changes to Terms We reserve the right to modify these Terms at any time. We will provide notice if a revision is material. By continuing to use our Services after revisions become effective, you agree to be bound by the revised terms.
